Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Luminosity platform ("Service"), operated by Luminosity ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

Luminosity is an AI-powered event photography platform that enables photographers to upload event photos, automatically detect faces using facial recognition, and allow guests to find their photos by uploading a selfie.

2. Accounts

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and truthful information during registration.
  • One person may not maintain multiple accounts.
  • You may delete your account at any time via the Settings page. Account deletion is permanent and removes all your data, events, photos, and face collections.

3. Credits and Payments

  • Creating an event requires one event credit. Credits are purchased via our payment partner, Viva Payments.
  • The current price is displayed on the pricing page at the time of purchase.
  • Credits do not expire.
  • Credits are non-refundable once an event has been created (as the credit has been consumed and AWS resources provisioned).
  • Unused credits may be refunded upon request at our discretion.
  • We may offer promotional credit codes from time to time. These are subject to their own terms (expiry dates, usage limits) and may not be exchanged for cash.

4. Content and Intellectual Property

4.1 Your Content

You retain full ownership and copyright of all photos you upload. By uploading content, you grant Luminosity a limited, non-exclusive license to store, process, display, and transmit your photos solely for the purpose of providing the Service (hosting, face detection, generating thumbnails and previews, watermarking, and serving to authorised viewers).

This license terminates when you delete the content or your account.

4.2 Responsibility for Content

You are solely responsible for the content you upload. You represent that:

  • You have the right to upload and share the photos (you are the photographer or have the photographer's permission)
  • Your content does not violate any laws, including privacy, copyright, or data protection laws
  • You have obtained any necessary consent from individuals photographed, particularly regarding face detection processing
  • Your content does not contain illegal, harmful, or objectionable material

4.3 Guest-Uploaded Content

When guests upload photos to your event, you (the photographer) are responsible for moderating that content. Luminosity provides moderation tools (approve/reject) but does not review guest uploads proactively.

5. Face Recognition

  • Face detection is performed automatically on uploaded photos as a core feature of the Service.
  • Face matching (selfie scan) is initiated voluntarily by guests and is not required to view or download event photos.
  • As the photographer, you are the data controller for face data generated from your event photos. You must ensure you have a lawful basis (such as legitimate interest or consent) for using facial recognition at your events.
  • We recommend informing event attendees that facial recognition will be available and providing clear signage or notices at the event.
  • We do not use face data for any purpose beyond matching guests to their photos within the same event.
  • We do not perform cross-event facial recognition or build profiles across different photographers' events.

6. Acceptable Use

You agree not to:

  • Use the Service for surveillance, stalking, or tracking individuals without their knowledge
  • Upload photos without appropriate rights or consent
  • Use facial recognition to identify individuals for purposes unrelated to event photography
  • Attempt to extract, reverse-engineer, or download face vectors or recognition models
  • Circumvent rate limits, access controls, or security measures
  • Use the Service to distribute malware, spam, or illegal content
  • Resell, sublicense, or white-label the Service without written agreement
  • Scrape, crawl, or systematically access the Service via automated means

7. Availability and Support

  • We aim to provide a reliable service but do not guarantee 100% uptime.
  • We may perform maintenance that temporarily affects availability.
  • Face detection accuracy depends on photo quality, lighting, and AWS Rekognition's capabilities. We do not guarantee specific accuracy rates.
  • We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

8. Collaborators and Team Access

  • You may invite other registered users to collaborate on your events. Collaborators have the same access as you except they cannot delete the event.
  • You are responsible for who you invite. Collaborators can view, upload, and manage photos, people, and settings for the events they are invited to.
  • You may remove collaborators at any time.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any loss of photos, data, or revenue arising from service interruptions, AWS outages, or technical failures.
  • Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We are not liable for the actions of event guests, including how they use photos they download from your events.

10. Termination

  • You may terminate your account at any time via the Settings page.
  • We may suspend or terminate your account if you violate these Terms, with notice when feasible.
  • Upon termination, all your data, events, photos, and face collections are permanently deleted. This action cannot be undone.
  • Payment records are retained as required by tax and accounting regulations.

11. Governing Law

These Terms are governed by the laws of the Hellenic Republic (Greece) and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Athens, Greece, unless otherwise required by applicable consumer protection laws.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
